NicheNet Terms of Service
These Terms of Service (“Terms”) govern your use of NicheNet at https://nichenet.fynktech.com and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. Last updated October 16, 2026.
1. The Service
NicheNet is a listing helper for makers and sellers who list their own handmade or otherwise Etsy-eligible items in a shop they own or are authorized to operate. You describe your product, NicheNet can help draft listing fields and optional photo layouts from materials you provide, and you review everything before it is sent through Etsy’s official Open API v3 with your OAuth consent.
NicheNet does not scrape Etsy.com for shop or listing data. Default behavior is draft-first: listings are saved as drafts unless you choose to publish after your own review. Optional AI features only suggest text or photo treatments — they do not auto-approve or auto-publish without your action.
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate account information and keep your login credentials secure.
- You are responsible for activity under your account.
- Accounts may be created or limited by a NicheNet operator (login access, credits, platform window).
3. Etsy connection
- You connect your own shop through Etsy’s OAuth. We never ask for your Etsy password.
- You must have the right to connect that shop and to list products you submit.
- You remain responsible for complying with Etsy’s seller policies, Creativity Standards, Handmade Policy, fees, and applicable law. NicheNet is for your own eligible items — not for mass-produced resale that violates Etsy’s rules.
- You can disconnect the app in Etsy → Settings → Privacy & security → Apps, or from NicheNet’s integration settings when available.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, infringing, counterfeit, or deceptive listings or content
- List mass-produced or ineligible items in violation of Etsy’s Creativity Standards or Handmade Policy
- Publish misleading titles, descriptions, or photos that do not accurately represent the product you make or sell
- Use AI outputs to invent product attributes, materials, origins, or images that misrepresent the item
- Attempt to conceal, evade, or “stealth” around Etsy’s policies, detection systems, or review processes
- Abuse rate limits, attempt unauthorized access, or disrupt the Service
- Misrepresent shop identity or list for shops you are not authorized to operate
- Upload content you do not have rights to use
- Use Etsy data obtained through the Service except as allowed by Etsy’s terms and these Terms
5. Human review required
Before publishing (or converting a draft to active), you must review every field and image. NicheNet may suggest copy or photo treatments; you decide what goes live and are solely responsible for accuracy, policy compliance, and customer-facing claims.
6. Plans, credits, and payments
NicheNet may offer plans or credit packs that control login access and optional drafting credits (for example listing text or photo helpers). Plan details are shown in the product. Credits are consumed as described in the Service. Unless required by law, fees already paid are non-refundable once access or credits have been granted. Billing may be handled manually by NicheNet support unless an automated processor is added later.
7. Optional AI drafting
Optional AI features can help draft listing text or suggest photo layouts from inputs and photos you provide about your own product. AI results can be inaccurate. You must review all titles, descriptions, images, and listing fields before publishing. Do not use AI to create fake or substituted product imagery. You are solely responsible for what you publish.
8. Intellectual property
NicheNet’s software, branding, and site content belong to us or our licensors. You keep ownership of content you submit. You grant us a limited license to process that content solely to operate the Service for you (including sending it to Etsy or AI providers when you use those features).
9. Etsy Application Disclaimer (required)
DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY NicheNet (THE “APPLICATION DEVELOPER”). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LISTINGS, PRICES, OR AI DRAFTS WILL BE ACCURATE OR SUITABLE FOR YOUR BUSINESS. ETSY IS A THIRD-PARTY PLATFORM; WE ARE NOT RESPONSIBLE FOR ITS AVAILABILITY, POLICIES, OR ACTIONS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICHENET AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO NICHENET FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM (OR USD $50 IF YOU PAID NOTHING).
12. Indemnity
You agree to indemnify and hold NicheNet harmless from claims arising out of your listings, content, shop activity, misuse of the Service, or violation of these Terms or third-party rights.
13. Suspension and termination
We may suspend or terminate access if you violate these Terms, if required for security or legal reasons, or if your plan or platform access expires. You may stop using the Service at any time and request account deletion as described in the Privacy Policy.
14. Privacy
Our Privacy Policy explains how we collect and use personal and shop data. By using the Service, you also agree to that policy.
15. Changes
We may update these Terms by posting a new version on this page with an updated date. Continued use after changes means you accept the updated Terms. If you do not agree, stop using the Service and disconnect your shop.
16. Governing law
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Courts in Pakistan have exclusive jurisdiction, except where mandatory consumer protections in your country say otherwise.

The term “Etsy” is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.
NicheNet is an independent product. We access shop data only through Etsy’s official Open API v3 with OAuth consent. We do not screen-scrape Etsy.com for shop or listing data.
